By signing up for the All Day Lending SMS service on our website, you are acknowledging your agreement to join the All Day Lending Service, abide by these Terms of Use, and receive messages on your mobile phone. Upon subscribing to the All Day Lending service, you will receive recurring messages.
Fees:
Participation in the All Day Lending Service does not incur any charges from All Day Lending. However, standard message and data rates may apply as imposed by your wireless carrier. For information on text messaging fees, please consult your wireless carrier. All Day Lending cannot be held responsible for any fees levied by your wireless carrier for using The All Day Lending service.
Privacy:
At All Day Lending, we highly value and safeguard your privacy. We do not share any collected information. To review our Privacy Policy, please refer to the appropriate section.
Limitations on Use:
To register for and utilize the All Day Lending service, you must be at least 17 years old. If you are under 17 years old, please seek parental consent before signing up for the All Day Lending service.
Supported Carriers:
Mobile carriers are not liable for delayed or undelivered messages. Participating carriers include T-Mobile®, Verizon Wireless, AT&T, Sprint, Boost, U.S. Cellular®, MetroPCS, Virgin Mobile, and Cricket.
Support Issues, Canceling or Unsubscribing:
You have the option to opt out of the All Day Lending service at any time by sending a text message with the keywords STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to {Insert Program Code}. Message and data rates may apply. Alternatively, you can email [email protected] using your mobile phone number as the subject line. For assistance or other support matters, you can also send an email to [email protected] or text HELP to {Insert Program Code} from your mobile phone, or call the toll-free number 833-849-8013. Message frequency is based on account activity.
Ownership; Trademarks; Modifications to Offers:
By agreeing to these terms, you acknowledge that All Day Lending or its partners hold all legal rights, titles, and interests in the All Day Lending services and any offers provided through the All Day Lending services, including any associated intellectual property rights. You agree not to modify any offers made through the All Day Lending service, and not to remove, obscure, or alter any proprietary rights notices (including copyright or trademark notices) affixed to the All Day Lending services or offers. Unless expressly authorized by a partner, you agree not to use any Trademarks (service marks, trade names, or logos) of any entity in a way that may cause confusion regarding ownership or be detrimental to the goodwill associated with such Trademarks.
Termination:
All Day Lending reserves the right, at its sole discretion, to terminate your subscription at any time without notice or future obligation.
Disclaimer of Warranties:
All Day Lending provides no warranties, express or implied, regarding the All Day Lending service. The service is provided “as is” and “as available,” and All Day Lending DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Factors beyond the control of All Day Lending , such as the speed of mobile carrier networks and the internet, may impact the service’s performance. All Day Lending is not responsible for any acts beyond its control.
Limitation of Liability:
Under no circumstances will All Day Lending, its officers, directors, employees, or agents be liable to you for any damages arising from your use of the All Day Lending service. This includes, but is not limited to, direct, indirect, incidental, consequential, exemplary, or special damages, even if advised of the possibility of such damages. If any disclaimer or limitation on damages or liability set forth herein is prohibited by applicable law in a particular circumstance, All Day Lending will be entitled to the maximum disclaimers and/or limitations on damages and liability available under such applicable law. Notwithstanding the foregoing, in no event will All Day Lending be liable for any damages or liability arising under these terms of use or your use of the All Day Lending service that exceeds US $500.
Indemnity:
You agree to indemnify and hold harmless each party associated with All Day Lending from any claim, demand, damages, costs, or expenses, including reasonable attorneys’ fees and costs, arising from your breach of this agreement or the referenced documents, or your violation of any law or the rights of another party.
Governing Law; Venue:
This agreement, including its validity, construction, and performance, will be governed by the laws of the state of Massachusetts, without regard to its choice of law provisions. You agree to accept the exclusive personal jurisdiction of the state and federal courts of Massachusetts and waive any objections to the venue of such courts.
